Terms of Service

1. Scope & provider

These Terms of Service govern the use of the RailFree app, provided by Roland Bieg (contact: support@railfree.app). The use of the app is additionally subject to Apple’s standard licence agreement (“Licensed Application End User License Agreement”). Apple is not a party to these Terms and is not responsible for the app or its support; however, Apple is a third-party beneficiary and entitled to enforce these Terms against you.

2. Description of the service

RailFree predicts, for selected level crossings, when the barrier is expected to close and for how long. The predictions are based on real-time and timetable data (including from SBB/SIRI-ET) and on a calculation model.

3. Important notice on accuracy and safety

RailFree’s predictions are non-binding estimates. No warranty is given as to accuracy, completeness, timeliness or availability. The displayed times must never be used as a basis for traffic or safety decisions. Always obey the actual barrier, light signals, signage and applicable traffic rules. Do not use the app while driving, except through an interface explicitly approved for that purpose (CarPlay). To the extent permitted by law, no liability is accepted for damage arising from reliance on the predictions.

4. Account & registration

An account is required in order to use the app. You provide truthful information and are responsible for keeping your credentials confidential. Use is reserved for persons aged 16 and over.

5. Subscriptions

RailFree is offered as a paid subscription (the “Normal” and “Premium” plans). The price shown in the App Store or in the app at the relevant time is authoritative. After a free 7-day trial, the subscription becomes paid. Purchase, automatic renewal, cancellation and refunds are handled by Apple via your Apple ID; you cancel a subscription in your device’s App Store settings. Family Sharing is supported. Apple provides notice of upcoming renewals in accordance with its standard.

6. Acceptable use

In particular, the following are prohibited: misuse of the service, automated scraping of data, reverse engineering of the app (except where mandatorily permitted by law) and the deliberate falsification of calibration data.

7. Intellectual property

The name and trademark “RailFree” and the content of the app are protected. Use of the app does not grant you any rights beyond this.

8. Availability, changes, termination

There is no claim to uninterrupted availability of the service. We may further develop, change or discontinue the service. In the event of serious breaches of these Terms, we may block access.

9. Warranty & liability

Liability is limited to the extent permitted by law. Mandatory consumer protection rights remain unaffected.

10. Changes to these Terms

We may amend these Terms of Service. The version published here is authoritative. By continuing to use the app after a change, you accept the amended Terms.

11. Governing law & place of jurisdiction

Swiss law applies. To the extent permitted by law, the place of jurisdiction is the Canton of Zurich. A mandatory consumer place of jurisdiction at the consumer’s domicile remains reserved.
